II. Purpose and legal basis of data processing

The legal basis for the processing of your personal data (essentially contact data such as name, business contact, telephone number, email address) is Art. 6 para. 1 sentence 1 lit. b GDPR. The necessity of processing your personal data arises due to the implementation of pre-contractual measures that precede a contractually regulated business relationship with you or due to the fulfilment of obligations arising from a contract concluded with you.

III. Processing of your data by service providers

When processing data, we use external service providers who are strictly bound by our instructions and who support us as part of IT support or other services. These service providers have been selected by us according to their qualifications and technical and organisational security measures; there are contracts for commissioned data processing in accordance with Art. 28 GDPR.

We do not transfer your data to organisations outside the EU or the EEA.

IV. Storage period and deletion

We store your personal data for as long as this is necessary to fulfil the purpose and no statutory retention obligations prevent earlier deletion.

In addition, we store your data for ten years (Section 147 (1) AO) or six years (Section 257 (1) HGB) at the end of the calendar year as part of our retention obligations under tax and commercial law.

If you assert your rights as a data subject, your personal data will be stored for 3 years after the final response to prove that we have provided you with comprehensive information and that the legal requirements have been met.

V. Your data protection rights

You have the right to receive information about the personal data stored about you free of charge upon request in accordance with Art. 15 para. 1 GDPR.

In addition, if the legal requirements are met, you have the right to rectification (Art. 16 GDPR), erasure (Art. 17 GDPR) and restriction of processing (Art. 18 GDPR) of your personal data.

If the data processing is based on Art. 6 para. 1 sentence 1 lit. e or lit. f GDPR, you have the right to object in accordance with Art. 21 GDPR. If you object to data processing, this will not take place in future unless the responsible can demonstrate compelling legitimate grounds for further processing which override your interests as the data subject in objecting. Please send your objection to: datenschutz@comcredit.de.

If you have provided the processed data yourself, you have a right to data portability in accordance with Art. 20 GDPR.

Please contact the data protection officer in writing or by e-mail in the cases mentioned above, if you have any questions or complaints.

You also have the right to lodge a complaint with a data protection supervisory authority. The data protection supervisory authority of the federal state in which you live or in which the responsible has its registered office or in which the breach of data protection occurred is responsible.
